By accessing or using DamImages ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

DamImages is a photography portfolio and booking platform that connects photographers, studios, and clients. The platform allows users to:

• Create and manage photography portfolios
• Upload, share, and organize photos into albums
• Post stories that expire after 24 hours
• Book photography services
• Communicate with other users
• Follow and interact with photographers and studios

3. User Accounts

3.1 Registration

To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding your password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

DamImages offers two types of accounts: Photographer and Studio. Each account type has specific features and capabilities tailored to different user needs.

4. User Content

4.1 Ownership

You retain all ownership rights to the content you upload to DamImages. By uploading content, you grant DamImages a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content on our platform.

4.2 Content Guidelines

You agree not to upload, post, or transmit any content that:

• Infringes on any intellectual property rights
• Contains explicit, violent, or inappropriate material
• Violates any applicable laws or regulations
• Contains spam, malware, or harmful code
• Impersonates any person or entity

4.3 Content Removal

DamImages reserves the right to remove any content that violates these terms or that we deem inappropriate for the platform.

5. Bookings and Payments

5.1 Booking Requests

Clients can submit booking requests to photographers and studios through the platform. All booking details, including pricing, are negotiated directly between the parties.

5.2 Payment Processing

DamImages does not process payments directly. All financial transactions are handled between the client and the service provider. We recommend using secure payment methods.

5.3 Cancellations

Cancellation policies are determined by individual photographers and studios. Discuss cancellation terms before confirming any booking.

6. Conduct and Responsibilities

You agree to use DamImages responsibly and respectfully. Prohibited activities include:

• Harassing, abusing, or harming other users
• Impersonating other users or misrepresenting your identity
• Attempting to gain unauthorized access to the platform
• Using automated scripts or bots to interact with the platform
• Scraping or copying content without permission

7. Intellectual Property

The DamImages name, logo, and all related trademarks are owned by DamImages. You may not use our trademarks without prior written permission. All content on the platform not uploaded by users is the property of DamImages.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal information.

9. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that violates these terms or is harmful to other users. You may delete your account at any time through the Settings page.

10. Disclaimer of Warranties

DamImages is provided "as is" without any warranties, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or secure. We are not responsible for the actions of users or the quality of services provided.

11. Limitation of Liability

To the maximum extent permitted by law, DamImages shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform.

12. Modifications to Terms

We may modify these terms at any time. Continued use of the platform after changes constitutes acceptance of the modified terms.

13. Governing Law

These terms shall be governed by and construed in accordance with the laws of Kenya, without regard to its conflict of law provisions.
